Terms of Service

1. Acceptance of terms

These Terms of Service ("Terms") govern your use of the TollGate mobile application ("TollGate," "the app," "the Service"), provided by the TollGate team ("we," "us," "our"). By downloading, installing, or using TollGate, you agree to these Terms. If you don't agree, don't use the app.

2. The service

TollGate lets you gate apps and alarms on your device behind a physical toll — a set of push-ups or jumping jacks, counted and form-checked by pose detection running on your device's camera. TollGate also includes optional gamification features (XP, levels, streaks, achievements, and a leaderboard). TollGate is available for iOS and Android.

3. Subscriptions & billing

Certain TollGate features require a paid subscription. As of this writing, TollGate offers:

  • Annual plan — $59.99 per year (equivalent to $5.00/month), billed once a year.
  • Monthly plan — $14.99 per month, billed every month.

Prices are shown in US dollars and may vary by region or change over time; the price you agreed to at purchase is shown in your App Store or Google Play receipt. Subscriptions are purchased and billed through the Apple App Store or Google Play, using the payment method on file with that account — we do not process payments or store payment card details ourselves.

Subscriptions renew automatically at the end of each billing period (monthly or annual, matching your plan) unless you cancel at least 24 hours before the current period ends. Your account will be charged for renewal within 24 hours prior to the end of the current period, at the then-current price for the plan you selected.

4. Free trial

The annual plan includes a 3-day free trial for new subscribers. You can use all subscriber features during the trial at no charge. If you don't cancel before the trial ends, you'll be charged the full annual price ($59.99) and your subscription will continue on an annual, auto-renewing basis. Unused portions of a free trial are forfeited if you purchase a paid subscription during the trial period, where applicable under the platform's rules.

5. Cancellation

You can cancel your subscription at any time. Because purchases are made through Apple or Google, cancellation is handled through your platform account, not through TollGate or this website:

  • iOS: Settings → [your name] → Subscriptions → TollGate → Cancel Subscription.
  • Android: Google Play app → Menu → Subscriptions → TollGate → Cancel.

Cancelling stops future renewals; you'll keep access to paid features until the end of the period you've already paid for. We don't issue refunds directly — refund requests are handled by Apple or Google under their own refund policies.

6. Acceptable use

You agree not to:

  • Use TollGate for any unlawful purpose, or in a way that violates any applicable law or regulation.
  • Attempt to reverse engineer, decompile, or tamper with the app's pose-detection or anti-cheat systems.
  • Use automated means (bots, scripts, emulator manipulation) to fake reps or manipulate your leaderboard standing.
  • Impersonate another person or submit misleading display names or content to the leaderboard.
  • Interfere with or disrupt the integrity or performance of the Service.

We may suspend or terminate accounts that violate this section.

7. Health and safety disclaimer

Please read this section carefully. TollGate asks you to exercise, and that carries real physical risk.

TollGate is not a medical device and does not provide medical advice. Before using TollGate, especially if you have a heart condition, are pregnant, have a musculoskeletal injury, or have any condition that could make push-ups or jumping jacks unsafe, consult a physician.

Stop immediately if you feel pain, dizziness, chest discomfort, or shortness of breath while completing a toll, and seek medical attention if symptoms persist. Exercise at your own pace and within your own physical limits — the app counts reps, it does not know your medical history.

Every gate in TollGate includes an escape hatch that lets you bypass a toll without completing it. It costs XP and breaks your streak, but it is always available, including when you are injured, unwell, or otherwise unable to safely exercise. Use it. Your safety takes priority over a streak.

To the fullest extent permitted by law, you assume all risk of injury arising from your use of TollGate's exercise features, and we disclaim liability for injuries sustained while using the app, except to the extent such liability cannot be excluded under applicable law.

8. Camera & content

TollGate uses your device camera to count reps via on-device pose detection. Camera frames are processed locally and are not recorded, stored, or transmitted — see our Privacy Policy for full detail. If you choose to appear on the leaderboard, the display name and country flag emoji you submit must not be obscene, harassing, or infringe on anyone else's rights; we may remove leaderboard entries that violate this.

9. Intellectual property

TollGate, its logo, and its underlying software are owned by us or our licensors and protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use TollGate on devices you own or control, for your personal, non-commercial use, subject to these Terms. You may not copy, modify, distribute, sell, or lease any part of the Service, or reverse engineer it, except as permitted by law.

10. Disclaimer of warranties

TollGate is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the app will be uninterrupted, error-free, or that rep counting or anti-cheat detection will be perfectly accurate in every condition of lighting, camera placement, or movement.

11. Limitation of liability

To the fullest extent permitted by law, TollGate and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, goodwill, or other intangible losses, arising from your use of or inability to use the Service — including any injury sustained while performing exercises within the app. Our total liability for any claim arising from these Terms or the Service will not exceed the amount you paid us in the twelve (12) months before the claim arose, or $50, whichever is greater. Some jurisdictions don't allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

12. Termination

You may stop using TollGate at any time by deleting the app. We may suspend or terminate your access to TollGate if you violate these Terms. Termination doesn't entitle you to a refund for any period already paid for; see Cancellation above for how subscription billing stops.

13. Changes to these terms

We may update these Terms from time to time. If we make a material change, we'll update the "last updated" date above and, where appropriate, notify you in the app. Continuing to use TollGate after a change takes effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of [Governing Law Jurisdiction — to be confirmed], without regard to its conflict-of-law principles. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts located in that jurisdiction, except where applicable law requires otherwise.
